Miguna was representing petitioners; Armstrong Kiwoi and Thomas Mnyambu Jumwa challenging Samboja’s August 8 win.
The two challenged the authenticity of the county boss’ Kenyatta University degree.
But Justice Eric Ogola said that they had no powers and time to investigate and determine the genuineness of Samboja’s credentials.
”All election cases should be heard and determined by the end of February, and therefore this court hasn’t enough time to determine the matter before then,” he said.
The Judge while making the ruling noted that the petition was a ‘waste of the court’s time.’
