NASA flag bearer Raila Odinga has withdrawn from the October 26 repeat polls as scheduled by the IEBC.
Odinga has asked the electoral body to call for fresh elections in 90days as is required by the law.
”Our withdrawal from the election requires the IEBC to cancel the election and to conduct fresh nominations,” Raila said.
The Elections Act 2011, Section 13 (1) states: “A political party shall nominate its candidates for an election under this act at least ninety days before a general election under this Act in accordance with its constitution rules.”
Withdrawing his candidature, Odinga has said that the move is in ‘the best interest of the country and a win-win for everyone.’
BAD FAITH
The opposition has accused the IEBC of not making changes to its personnel or the providers that were behind the bungled election.
”For over five weeks, the commission has engaged us in a ping pong game well knowing they had no intention to streamline the electoral system to accord with the constitution and electoral laws.
”This is coupled with the retention of the same service providers that were complicit in the worst electoral fraud ever witnessed in modern times including Safran/OT Morpho, Al Ghurair.”
The Jubilee government was also accused of planting commissioners doing their bidding for them inside the commission; CEO Ezra Chiloba and three others.
”It is now evident that jubilee is firmly in charge of IEBC through four commissioners who have set out to implement the jubilee agenda within the commission.”
The former Prime Minister has maintained that he will not be party to the fresh elections should the commission’s CEO Ezra Chiloba and the secretariat not leave office.

The opposition has over the past few weeks said that ‘no reforms, no elections’ with reference to the irreducible minimum demands presented to the commission.
Speaking to Citizen Tv on Sunday, Leader of Majority in the Senate, Kipchumba Murkomen said that Odinga was going to withdraw from the race, latest Wednesday.
He stated that the ODM party leader’s move was meant to cause chaos in the country, a move they (Jubilee) are ready to counter.
The opposition will according to Siaya Senator, James Orengo hold demonstrations all over the country on Wednesday as scheduled.
