A petition challenging Budalangi MP, Raphael Wanjala’s August win has been thrown out.
The petition was filed by two voters who are said to have close ties with the former area MP and Labour Party of Kenya leader, Ababu Namwamba.
Mercy Achieng Mola and John Ndagwa filed the case at the Busia High Court, a case that sparked controversy as Namwamba had decamped to Jubilee party which claimed that the August election had been conducted in a free and fair manner.

Namwamba is said to have lost his seat after he hurriedly left the Raila Odinga led ODM party. He claimed that Odinga had set him for failure and did not support his secretary general bid.
But Namwamba has maintained his relationship with the President, having run the ‘Mbele Iko Sawa’ campaign and is rumored to be up for a top government job.
Wanjala garnered 11, 182 votes against Ababu’s 9,975 votes.
