Maisy Chesang Pleads With Court Not To Hold Her In Same Prison As Inmates She Convicted

Senior Nyeri magistrate, Pauline Maisy Chesang has pleaded with a Machakos court not to detain her at Machakos G.K prison.

According to Ms Chesang who is said to have conspired with police officers to kill her husband, lawyer Robert Chesang, she is likely to come face to face with inmates she sentenced.

Instead, the mother of two, through her lawyer Assa Nyakundi, requested to be held at Athi River Police Station.

“If she must be remanded, I pray that she be held at Athi River Police Station and not Machakos where she is likely to encounter inmates whom she might have sentenced while serving in some stations,” her lawyer told a Machakos court.

Nyakundi also asked the court to let his client go on grounds that she had rendered distinguished service to the Judiciary.

“The first accused is a serving magistrate and has not yet taken plea. She is innocent until proven guilty. Keeping her further in custody is an affront to her constitutional rights, and further more she has rendered distinguished service to the judiciary for many years,” the advocate said.

    The prayer was rejected.

She will however be held at Athi River while her co-accused; Richard Moru, Lawrence Lempesi and Peter Maundu, will be detained at Machakos G.K Prison.

The court also ordered that they all undergo mental health assessment tests at Mathari Hospital in the next two weeks.

They will therefore take pleas on April 9, 2019.

Lawyer Chesang was shot seven times by his assailants at his Lukenya, Machakos county home.
