The EACC has been warned by the Law Society of Kenya (LSK) against attacking the independence of the Judiciary by probing the Supreme Court Registrar, Esther Nyaiyaki.
Ms Nyaiyaki has been accused of gross misconduct.
The LSK Chairman, Isaac Okero said EACC’s move was against the constitution and an attack on the arm of the government.
”The Judiciary in the performance of its functions under the Constitution exercises delegated sovereign authority of the people of Kenya. It would be an affront to and violation of this sovereign authority for the EACC to proceed with the proposed enquiry and investigation,”he said.
Okero further stated that the commission should let organs within the Judiciary take up the investigations.

The commission wants the registrar to submit reports believed to have led to the nullification of the Presidential election.
A petitioner, Rashid Mohammed has asked that Ms Nyaiyaki be investigated for misleading the SCOK judges.
