The Court of appeal has upheld the election of Starehe MP, Charles ‘Jaguar’ Njagua Kanyi.
This comes after businessman Steve Mbogo appealed the High Court’s decision that it did not find an error in the election’s compliance with the constitution.
The High Court had dismissed the case for lack of sufficient evidence and on Friday at the Court of Appeal Justice Agnes Murgor ruled that the High Court Judge failed by not asking for a recount of the votes.
“The High Court Judge misapprehended the law on the issue of failure to demand for a recount at the polling station,” Justice Murgor said.
She said that there was nothing to prove that there was major irregularities that could warrant nullification of the election.

In other news, Embu Governor, Martin Wambora’s election has also been upheld by the Court of Appeal after he challenged the decision of the High Court to nullify his election back in February, 2018.
Justice Fatuma Sichale ruled that the minor irregularities did not warrant the nullification of the election.
