Officials of the Independent Electoral and Boundaries Commission (IEBC) can breathe a sigh of relief following the Supreme Court ruling there was no ‘criminal culpabilty’ despite evidence presented in court in Raila Odinga’s presidential petition.
The court acknowledged that there were several electoral malpractices in the August 8 General Election but it was not able to identify specific individuals involved in the incident.
“No evidence was placed before us to prove that electoral offences were committed by officials of IEBC. What we saw in evidence was a systematic institutional problem and we were unable to find specific fingerprints of individuals who may have played a role in the commission of irregularities,” Chief Justice David Maraga stated.
“We are therefore unable to impute any criminal intent or culpability on either the IEBC Chairman or any other Commissioner or member of IEBC.”

National Super Alliance (NASA) has insisted that the Director of Public Prosecutions investigate the electoral body officials and seal off the headquarters, referring to them as ‘scene of crime.’.
However, Director of Public of Prosecutions Keriako Tobiko postponed carrying out any action against the Commission following the Supreme Court’s full verdict.
