The High court through Justice John Mativo said that the court has no jurisdiction to form the care taker government that activist Okiya Omtatah was asking for.Justice Mativo said that okiya Omtatah ought to have filed the case at the Supreme Court instead.
The activist had proposed that a caretaker government headed by the chief Justice be constituted so as to enable the IEBC to conduct the Fresh presidential elections in accordance with the constitution.

He suggested that if not the chief Justice, NASA and Jubilee should appoint a team to run the caretaker government for a period of 60 days days before the fresh election. The High court has however said that it has no jurisdiction over the formation of a caretaker government.
The high Court had earlier granted the activist an injunction to stop the IEBC from swearing Uhuru Kenyatta after Raila Odinga withdrew from the election on October 10.
