    Hassan Omar Withdraws Petition Challenging Joho’s Win

    hassan omarFormer Mombasa Senator, Hassan Omar has withdrawn his petition challenging Mombasa Governor, Ali Hassan Joho’s August win.

    The former legislator cites partiality of the judge, Justice Lydia Achode.

    ”It will be hypocritical for the petitioners to proceed with this matter when they believe that the honourable court is already biased against them,” he said in his withdrawal petition.

    On January 8, Omar through his lawyer Yusuf Aboubakar requested that the judge recuse herself and take the file to the Chief Justice to appoint another judge to hear the petition.

    The judge, he said heard and granted applications by Joho and the IEBC but rejected his.

    ”The presiding judge has given open latitude to the respondents’ advocates when cross-examining the petitioners and their witnesses but restricted the petitioner’s advocates when cross-examining the respondents and their witnesses,” he said.

    Hassan Omar challenged the ‘Sultan’s’ win as it was ‘marred with irregularities.’
