Chief Justice David Maraga has adjourned the hearing where three petitioners had filed a petition to have the fresh elections postponed.They were arguing that the current political environment is not conducive to conduct an election.
The chief justice said that they lacked quorum to sit through the hearing as four of the judges were unavailable. DCJ Philomena Mwilu could not come as she was traumatized from the shooting of her driver last night. Chief Justice Maraga asked the petitioners to pick an alternative date at the registry.
Haron Ndubi the lawyer for the petitioners said that he sensed mischief in the absence of the judges citing that they had received an order from the chief justice to attend the hearing today.

Justice Odunga has however stated that the appointment of the returning officers was illegal and a contravention of regulation 3 of the elections regulations.
The elections are therefore set to proceed with this adjournment as no court of law has made a specific order to cancel or postpone the elections.
