The court has dismissed senator Mithika Linturi’s bid to be reinstated on the graduation list so he can graduate on Friday.
The senator had been de-registered by the university of Nairobi senate on discovery that the documents he used to be admitted to the university in 2014 were forged. The senator had sued the university saying that his de-registration woes were a plot by his political opponents
His lawyer, Tom Ojienda, argued that the senator had not been given a right to reply by informing him.
Judge Odunga in his order said that his ruling was was not prejudicial as the senator did not show the court reason as to why failure to graduate would cause him irreparable damage. The case will be heard on February 20,2018
The senator was among the politicians who were blacklisted by the ethics and anti corruption commission before the August 8 elections for presenting forged academic papers.
