Court Dismisses Petition Compelling IEBC Announce Presidential Results In Seven Hours

Kisumu High Court on Monday ruled in favour of the Independent Electoral and Boundaries Commission (IEBC) dismissing a petition to have the commission announce the presidential election results within seven hours.

Justice David Majanja ruled that the Constitution gives a clear time frame when the presidential results should be announced. He further noted that the court had no power to give IEBC directives as it is an independent body.

The judge says the court found no basis that the fundamental rights and freedoms of the three, Titus Alila, Jackline Otieno and Francis Ogada, petitioners had been violated.

The three, through their Lawyer Ken Amondi, wanted the court to give clear guidance on the duration between the closure of voting and when the presidential results should be declared.

They will not petition the High Court ruling.
