Chief Justice David Maraga has thrown out Thirdway Alliance Presidential candidate, Ekuru Aukot’s petition.
The CJ constituted a three judge bench to hear Aukot’s case which sought to clarify whether he and other presidential candidates could take part in the fresh polls set for October 17.
Maraga has said that the presidential hopeful should have gone to the High Court instead of the Supreme Court.

The CJ together with other three judges annulled the August 8 presidential election causing the IEBC to plan for another election within 60 days in accordance with law.
The electoral body locked out the other candidates leaving for President Uhuru Kenyatta to battle it out with NASA’s Raila Odinga.
