Businessman Jimmy Wanjigi has filed a suit in court against Daily Nation who published a fake obituary of him earlier on in the year.

He has demanded that the publication pays Sh100 million for infringement of his privacy. Wanjigi said that his privacy was infringed upon as the publication published the names of his children, where they lived and schooled.

The businessman also said that the obituary caused him mental anguish. He said that the obituary amounted to threats to his life.


The Daily Nation however refuted publishing the obituary intentionally claiming that although the image looked similar to that of the businessman the name on the Obituary was James Richard Wanjagi.

They claimed that the police had already revealed where he lived during the raid that was televised and therefore the businessman could not claim that the publication revealed where he lived.

Wanjigi, an opposition supporter while talking to Cable News Network (CNN) had said that he would take legal action against the company.

“It’s a death promise, we are coming for you, we assure you we are going to finish you. I see the Nation media as being part of a conspiracy of premeditated murder, I don’t see it any other way,” Jimmy Wanjigi said.

There was a public outcry with a lot of people wondering how such a huge mistake was possible from a media house as big as the Nation media group.

The person who dropped and paid for the obituary is yet to be arrested.

The ruling will be given on April 9, 2019.
