Businessman Drags Nakumatt’s Atul Shah To Court Over Sh9.5 Million Liquor Debt

Struggling Nakumatt Holdings chief executive Atul Shah’s woes deepen as businessman Ngugi Kiuna drags him to court.

Mr Kiuna has sued Shah for defaulting a Sh9.5 million payment for liquor distributed to the chain of supermarkets.

Mr Shah in an application filed at the Milimani Law Courts is said to have issued the tycoon with 10 bad cheques in March 2017.

This forced him to take up the matter with the DPP and DCI who he says are yet to take action against Shah.

“This honourable court be pleased to summon the person currently in charge of the office of the director of public prosecutions to appear before it and show cause why despite the numerous follow ups by the applicant herein to his office, he has never reverted with any progress reports or status on the matter,” the application reads in part.

The alcohol supply agreement was entered into in 2006.

The businessman is now seeking to initiate private prosecution against Mr Shah should the DPP and DCI delay in taking action against the embattled CEO.

Mid this year, Shah said the firm is collaborating with the Court Appointed Administrator Peter Kahi to recalibrate the business through the remaining seven branches.

However, the retailer seems to be facing a bleak future, reeling under a Ksh30 billion debt owed to its suppliers, landlords and lenders.
