The court of appeal has nullified Lamu senator Anwar Loitiptip’s election. The court of appeal sitting in Mombasa ordered the Independent Electoral and Boundaries Commission (IEBC) to conduct fresh elections.
The high court had upheld the election of Anwar. The appellant who was also a candidate in the election appealed against the High court’s decision saying that the court erred by refusing to scrutinize the votes which is a an application he had presented.
He also said that in one polling station, Kinagwe primary school the votes that were cast were more than the number of registered voters.
He said that the High court also failed to recognize that his right to have polling agents was violated.
The Lamu Returning officer in that election had also made an admission that the senatorial race had errors saying that the Microsoft excel sheet had errors while summing up.
