Justice Makau Dismisses Cuban Doctors Petition, Cites Lack Of Evidence

High Court Justice Onesmus Makau of the Employment and Labour Relations Court has dismissed the case challenging the legality of the Cuban doctors contract with the government.

The petition filed by Conrad Maloba and Associates on behalf of three unemployed doctors, argued that Kenyan doctors should be given priority, in line with the Constitution but High Court Justice Onesmus ruled that there was not enough evidence provided to prove that the government violated the law in recruiting them.

“The petitioners have not proved that the doctors rights and the rights of other specialized doctors were infringed by the decision to import the Cuban doctors,” said the Judge.

However, Justice Onesmus acknowledged the government’s shortcoming in law for not involving the Doctors Union views before hiring their Cuban counterparts.

Qualified Kenyan doctors have argued that they should be hired since many are out there languishing in poverty and unemployment.

This decision consequently means that the Cuban doctors can now be deployed and begin to work in various hospitals across the country.

According to Health CS Sicily Kariuki, the least paid Cuban doctor will earn Ksh390, 270 and the highest paid will earn Ksh450, 660.
