There was a confrontation at the Supreme Court during the hearing by the IEBC chairman Mr. Wafula Chebukati sought to have the court clarify the his powers to verify and correct the errors in forms 34A and B.
Justice Mwilu asked IEBC lawyer Paul Muite to illustrate the aspects of the judgement that were not clear and which should be clarified by the court.

“Did we say, touch or move a coma, change figures? Did we say that in our judgment? Where? I don’t remember saying that and I know I participated in that judgment,” she said.
But lawyer Muite said that he wanted clarification on how the National returning officer should verify results before announcing the winner in a presidential election.
The Chief Justice David Maraga had to step in asking the the lawyer to read section 39 (1)(c) of the election laws which he read out loud. The Chief Justice said that that section was ‘simple’, But the IEBC lawyer asked the court to explain what they meant by saying the section was ‘simple’
The Supreme court will decide on Wednesday October 11 on whether to clarify the issues raised by Wafula Chebukati.
